New European patent with unitary effect

In early July, the European Cluster Collaboration Platform (ECCP) published an article about the new European patent with unitary effect that will enter into force on 1 January 2023. Currently, companies have two possibilities in terms of filing for patents: file for a patent per country of interest or filing for a European patent that involves a centralised procedure including 38 countries until grant. For the latter, the company has to choose the countries in which the patent will take effect through validations.

With the new European patent, companies are exempted from having to select the countries in which the patent will be effective; the new European patent will be active in all European countries that have accepted the reform. Additionally, if the company wishes to validate its patent in other European countries other than those that have signed the reform at the time of grant, it can file for a traditional patent validation simultaneously.
